About Course

Housing enforcement under Part 1 of the Housing Act 2004 is a duty, not a discretion, and from 23 June 2026 it runs on a reformed rating system. This course takes you from the first inspection to the charge on the premises, following one flat and one landlord through every stage, and it is built so that each decision you make can be explained afterwards.

What Will You Learn?

  • State where the duty to act comes from, distinguish a hazard question from a disrepair question, and name the eight squares of the enforcement route.
  • Identify the person having control, the person managing and the owner, and determine who each Part 1 notice is served on.
  • Explain what Part 1 provides and what it replaced, apply the right standard of proof to each kind of decision, and evidence a duty to have regard on the file.
  • Score a hazard under the reformed HHSRS from likelihood and outcome, place it in its band, and determine whether it is category 1 or category 2.
  • Select between an improvement notice, a prohibition order, a hazard awareness notice and emergency remedial action, and evaluate what each choice forecloses a year later.
  • Distinguish the s.6A penalty, the s.30 offence and the s.249A penalty, and state when each is available and against whom.
  • Triage one inspection across the electrical, alarm, gas and energy efficiency regimes and select the route that actually reaches the problem.
  • Record an inspection, write reasons, serve lawfully, and carry a case through appeal, works in default and recovery of the money.

Module 1: What Enforcement Is For
Why the authority enforces at all, who it can reach, and where the duty comes from. The module separates a hazard question from a disrepair question, works through the persons a Part 1 notice can be served on, sets out the section 5 duty, keeps the three pots of money apart, and ends by walking the whole enforcement route on a single case.

Module 2: The Legal Architecture
The legal architecture. What Part 1 provides and what it replaced, the satellite regimes that run alongside it, the standard of proof that applies to each kind of decision, and what a duty to have regard actually obliges a decision maker to do.

Module 3: HHSRS 2026
The reformed HHSRS. What changed on 23 June 2026, the 21 prescribed hazards and the four classes of harm, scoring from likelihood and outcome, the bands and the category 1 line, and what actually discharges the duty that follows.

Module 4: The Part 1 Tools
The Part 1 tools, one at a time and then against each other. The improvement notice drafted line by line, prohibition orders and hazard awareness notices, emergency remedial action, the s.6A penalty, and the choice between them with an eye on what each one forecloses.

Module 5: The Prescribed Standards Regimes
The prescribed standards regimes that run alongside Part 1: electrical safety and the EICR, smoke and carbon monoxide alarms, gas safety, and the minimum energy efficiency standard. The module ends by triaging one inspection across all four.

Module 6: Doing It Properly
Doing it properly. The inspection and the record it produces, reasons that show the decision was lawful, service, appeal and suspension, what to do when nothing happens, and recovering the money at the end of the route.
